I, for myself, my legal representatives and heirs, in exchange for the opportunity to receive instruction on injecting neuromodulators, dermal fillers (and other related instruction) from Injectables EDU, LLC (“Injectables EDU”):
ACKNOWLEDGE, AGREE, and REPRESENT that the information presented is time-sensitive and current as of the date presented. It is not a substitute for the expertise, skill, knowledge and judgment of healthcare practitioners. Although it is intended to be accurate, Injectables EDU assumes no liability for loss or damage due to reliance on the material and instruction provided. Advances in medicine may cause this information to become outdated, invalid, or subject to debate. Additional, important information about the products instructed upon is available from the manufacturers of such products and other sources. INJECTABLES EDU PROVIDES THE INSTRUCTION ON AN “AS IS” BASIS. ACKNOWLEDGE, AGREE, and REPRESENT that I am currently licensed to inject aesthetic injectables in such jurisdictions and on such third parties as I determine in my professional and sole discretion; and I further acknowledge, agree and represent that Injectables EDU and its agents, successors, and assigns shall not be liable for any improper or incorrect use of the information presented and taught to me or any neuromodulator injection made outside of the scope of my licensing and assumes no responsibility for anyone’s use of the information. IN NO EVENT SHALL INJECTABLES EDU BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OR SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO BRING ANY CLAIM or Action AGAINST INJECTABLES EDU, its members, officers, representatives, agents, successors, and assigns (each considered a “Releasee” herein), from all liability, claims, demands, fees (including attorneys’ fees), expenses, losses, or damages arising out of, caused or alleged to be caused in whole or in part by my use of the information and instruction provided me by the Releasees; and I further acknowledge and agree that if, despite this Waiver of Liability and Indemnity Agreement, a claim, action or lawsuit is filed against any of the Releasees arising out of, caused or alleged to be caused in whole or in part by my use of the information and instruction provided me by the Releasees, to the fullest extent permitted by law, I WILL INDEMNIFY, DEFEND, SAVE, AND HOLD HARMLESS each of the Releasees from any expenses, fees (including attorneys’ fees), loss, liability, damage, or cost which Releasees may incur as the result of such claim, action or lawsuit.
To the extent any provision of this Waiver of Liability and Indemnity Agreement should be held invalid by a court, such provision shall be severed and the remaining provisions shall remain in full force and effect.
I have read this Waiver of Liability and Indemnity Agreement, fully understand its terms, and sign it freely and without any inducement or assurance of any nature.
